Buying Products from us

1. How to pay

a) You can pay for Products using a debit card or a credit card. We accept most major debit and credit cards, including the following cards: Visa, MasterCard, and American Express.

b) By ordering Products from us through our Website, you authorise us to perform credit and anti-fraud checks on you and the payment method that you have provided. These checks may be required, among other things, to verify your identity, to validate your credit or debit card, to obtain an initial credit or debit card authorisation, and/or to authorise individual purchases. You authorise us to disclose information provided by you, including personal information, to third parties such as banks and the providers of credit reports for these checks, and accept that such parties may keep a record of that information. You also agree that we may make the information we receive from such checks available to third parties, including fraud prevention and credit reference agencies. We reserve the right to put in place additional payment security systems from time to time.

c) Credit cards are subject to verification and authorization by the card issuer. If the amount due by you for your order cannot be debited or invoiced, for whatever reason, we will not be responsible for any delay or failure to deliver and your order will be cancelled (we will inform you of this using the contact details you provided when placing the order).

d) Your debit card or credit card will not be charged until we issue an Order Confirmation (at which point we take payment for the Products and all applicable delivery charges in full).

2. Why was I charged sales tax for my online order?

We are required by law to charge Canadian Goods and Services Tax (GST) on all products shipped to addresses in Canada, and Canadian provincial sales taxes in provinces where we have a physical store location. We currently have a store in Québec

We do not charge any sales tax on gift card purchases, as the appropriate sales tax will be charged on the purchase when the gift card is redeemed.

 3. Our order process on our Website allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order on each page of the order process. In particular, please check the quantities of each of the Products in your order.

a) By clicking the "Check Out" button, you are committing to buy and pay for the Products in your order.

b) After you place an order, you will receive an email from us acknowledging that we have received your order and confirming the Products ordered.

c) If you want to buy Products as a business customer in connection with your profession or trade, please contact us using the details on the Contact Us page of the Website to discuss the options available to you.

Product prices and delivery charges

1. The prices of the Products will be as quoted on our Website from time to time. We take reasonable care to ensure that the prices of Products are correct at the time when the relevant information was entered into the system. However, it is always possible that, despite our efforts, some of the Products on our Website may be incorrectly priced. If we discover an error in the price of the Products you have ordered, we will contact you to inform you of this error, and we will give you the option of continuing to purchase the Products at the correct price or cancelling your order. We will not provide the Products to you at a lower price where there has been an obvious pricing error. We will not process your order until we have your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat your order as cancelled.

2. The prices of the Products may change from time to time, but changes will not affect any order that we have confirmed by sending an Order Confirmation. The prices of the Products are in Canadian Dollars.

3. The prices of the Products do not include taxes and delivery charges. We will advise you of the taxes and delivery charges during the checkout process, and they will be itemized in your order confirmation email

4. You agree to pay all charges or fees at the prices then in effect for your purchases, and you authorize us to charge your chosen payment provider for any such amounts upon making your purchase.  

Shipping

1. Orders are shipped Via Ground Delivery, typically shipped out within 7 - 10 business days from the date the order is placed. Business days are Monday to Friday, excluding Canadian holidays. When your order ships, you will receive an email with tracking information. Some orders may be subject to additional shipping & handling charges depending on the size and weight of the item or the package. If applicable, a customer service representative will contact you before shipping your order.

2. Since our items ship directly from our supplier. RUSH DELIVERY is not available.

3. Shipping charges will be calculated based on geographic location during checkout. Completed orders will ship using courier for the fastest delivery, where possible.

4. PO Boxes: Please note that we may not be able to deliver orders to PO Boxes. If we can ship to your P.O. Box address, there may be additional charges required. You will be contacted about any shipping issues.

 Delivery

1. If we are unable to meet the estimated delivery date or time because of an event outside of our control, we (or our delivery partner) will contact you as soon as possible to let you know, and we will take steps to minimise the effect of the delay. Provided we do this, we will not be liable for delays caused by the event, but if there is a risk of substantial delay, you may contact us to end the Contract and receive a refund for any Products you have paid for but not received.

2. Delivery will be completed when the Products are delivered to the address stated in the Order Confirmation (so please make sure that the delivery details you provide are accurate, as we cannot be responsible for any delayed or failed deliveries as a result of your error).

3. You are responsible for making suitable arrangements to receive your delivery. Please make sure you or someone instructed by you can take delivery of the Products.

4. If you do not collect the Products from us as arranged or if, after a failed delivery to you, you do not rearrange delivery or collect them from a delivery depot, we will contact you for further instructions and may charge for storage costs and any further delivery costs. 

Return Policy

1. We regret that wallpaper and fabric orders are non-refundable unless your wallpaper or fabric is flawed or damaged upon arrival. In the rare case that it happens, we’ll be happy to offer you a replacement or refund. Please contact us at info@verti-kal.com and include your order number along with a photo of the issue for quick processing. We recommend ordering a sample of your product to make sure you love it before ordering larger quantities.

2. We will accept returns within 30 days of your delivery date with a reference # from our Customer Service Team

3. Shipping costs are non-refundable.

4. Returns are made at your own expense.

 How to return an online order

3. Attach a receipt and a note on the reason for the return

4. Ship to the address that will be provided to you by our Customer Service Team.

 Changes to an order

1. If you wish to make a change to your order, you must contact us within 24 hours (Between Monday and Friday). We will let you know if the change is possible. If it is possible, we will let you know about any changes to the price of the Products, the timing for delivery, or anything else which would be necessary as a result of your requested change, and ask you to confirm if you wish to go ahead with the change

Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Company, its parent, subsidiaries, affiliates, and their respective directors, officers, employees, agents, service providers, contractors, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your breach of these Terms of Service or your use of the Website including, but not limited to, third-party sites and content, any use of the Website's content and services other than as expressly authorized in these Terms of Service or any use of any goods, digital products and information purchased from this Website.

Privacy Policy

Your provision of personal information through the Website is governed by our privacy policy located at /the "Privacy Policy".

Governing Law

The Website and these Terms of Service will be governed by and construed in accordance with the laws of the Province of Quebec and any applicable federal laws applicable therein, without giving effect to any choice or conflict of law provision, principle, or rule and notwithstanding your domicile, residence, or physical location. Any action or proceeding arising out of or relating to this Website and/or under these Terms of Service will be instituted in the courts of the Province of Quebec, and each party irrevocably submits to the exclusive jurisdiction of such courts in any such action or proceeding. You waive any and all objections to the exercise of jurisdiction over you by such courts and to the venue of such courts.

Severability

If any provision of these Terms of Service is illegal or unenforceable under applicable law, the remainder of the provision will be amended to achieve as closely as possible the effect of the original term, and all other provisions of these Terms of Service will continue in full force and effect.

Entire Terms of Service

These Terms of Service constitute the entire and only Terms of Service between the parties in relation to its subject matter and replaces and extinguishes all prior or simultaneous Terms of Services, undertakings, arrangements, understandings or statements of any nature made by the parties or any of them whether oral or written (and, if written, whether or not in draft form) with respect to such subject matter. Each of the parties acknowledges that they are not relying on any statements, warranties or representations given or made by any of them in relation to the subject matter of these Terms of Service, save those expressly set out in these Terms of Service, and that they shall have no rights or remedies with respect to such subject matter otherwise than under these Terms of Service save to the extent that they arise out of the fraud or fraudulent misrepresentation of another party. No variation of these Terms of Service shall be effective unless it is in writing and signed by or on behalf of the Company.

Waiver

No failure to exercise, and no delay in exercising, on the part of either party, any right or any power hereunder shall operate as a waiver thereof, nor shall any single or partial exercise of any right or power hereunder preclude further exercise of that or any other right hereunder.

Notice

We may provide any notice to you under these Terms of Service by: a) sending a message to the email address you provide to us and consent to us using; or b) by posting to the Website. Notices sent by email will be effective when we send the email, and notices we provide by posting will be effective upon posting. It is your responsibility to keep your email address current.

We may update the address for notices to us by posting a notice on this Website. Notices provided by personal delivery will be effective immediately once personally received by an authorized representative of the Company. Notices provided by overnight courier or registered, or certified mail will be effective once received, and where confirmation has been provided to evidence the receipt of the notice.

Shop at Home Terms and Conditions

1. Prices subject to change until receipt of final measurements: Prices set forth in your estimate are subject to change upon final measurements or based on any changes in sizing and/or items not reflected in the contract.

2. Deposit and Payment: To finalize your order, a 50% deposit is typically required. The final payment must be collected prior to installation.

3. Cancellation and Fees: Orders for custom products from our Shop at Home Department are not refundable or exchangeable

4. Delivery Timelines: Delivery timelines are based on our best estimates only and may change without notice due to factors beyond our control, including supplier backorders or production issues. Any changes in the proposed delivery time shall not entitle the customer to any refund or credit without express written permission of the Verti-Kal.

5. Light Leakage Warning: Regardless of the fabric name, type of blind or mechanism, or drapery, and notwithstanding any representations from your Custom Windows Specialist, some light may still enter through the sides or top of the window. The uneven structure of the window and other factors can also impact light blockage. For complete light blockage, floor-to-ceiling blackout pleated curtains are recommended.

6. Signature and Acceptance: By agreeing to the terms and conditions set forth in the signed estimate or document as well as those set forth herein (collectively the “Agreement”), the Customer acknowledges and affirms that it is their sole responsibility to thoroughly review and understand all aspects of the agreement, including any related terms, obligations, and conditions with regards to the product(s) purchased and the services provided. The Customer confirms that they have had the opportunity to ask questions, seek clarification, review any relevant product details on the supplier’s website and that they accept the terms in their entirety without any misunderstanding or misinterpretation.

7. Defects and Other Issues: If there is any defect or issue with the product upon delivery, please take photos and inform us within 24 hours of delivery. We cannot guarantee the perfection of any product installation such as minor, cosmetic or non-material issues based on outside factors such as uneven structure of a window, uneven floors, ceilings or other elements.

8. Warranty and Other Product Information: For specific product uses, specifications and information about Hunter Douglas products, refer to the Hunter Douglas website and reference guide at www.hunterdouglas.ca.  Warranty and other information about Alta Window Fashions products can be found at https://www.altawindowfashions.ca/maintenance-and-warranty.  

9. Customer Measurements and Self-Installation: If you provide your own measurements or opt for self-installation, you are responsible for ensuring accuracy and proper installation. We are not liable for any issues resulting from incorrect measurements or installation errors. Should you elect to forego a check measure service in connection with your purchase for any drapery orders, we shall not be liable for any resulting non-material errors or omissions. We recommend using professional services for measurement and installation to ensure optimal results.
